The Nagoya City Science Museum (hereinafter referred to as "the Museum") has established the "Nagoya City Science Museum Online Viewing Ticket Sales Terms and Conditions" (hereinafter referred to as "these Terms") as follows. Please use the Nagoya City Science Museum Online Viewing Ticket Sales Service (hereinafter referred to as "the Service") provided by the Museum after accepting these Terms.
Article 1 (Scope of Application and Amendment)
1.Customers who use the Service shall be deemed to have understood and accepted all the contents of these Terms.
2.These Terms shall apply when customers use the Service.
3.The Museum may amend these Terms without obtaining the prior consent of customers, and customers shall check these Terms each time. If customers use the Service after the Museum has amended these Terms, they shall be deemed to have agreed to the amendments.
Article 2 (Conditions of Use)
1.The Service is only available to customers who purchase Nagoya City Science Museum viewing tickets (hereinafter referred to as "tickets") via the Internet. Any use of the Service for purposes other than ticket purchase is prohibited.
2.The Service is intended for customers who can operate and use computers and the Internet at their own responsibility and who are using computers with appropriate settings, such as displaying Japanese characters and configuring settings such as email. The Museum shall not be responsible for any inability to use the Service due to circumstances on the customer's side, such as equipment, networks, operating systems, or providers, over which the Museum has no control.
3.When purchasing tickets, customers are required to enter their personal information (hereinafter referred to as "personal information"), such as their name, address, telephone number, and email address, in the designated form. In the event of incomplete information, unreadable characters, or false information, the customer's purchase application will be rejected.
Article 3 (Prohibited Activities)
1.Customers are prohibited from reselling tickets to third parties or providing tickets to third parties for resale, regardless of whether it is for profit. Additionally, transferring tickets to third parties free of charge for profit purposes is also prohibited.
2.Customers are prohibited from purchasing tickets for the purpose of reselling them to third parties or providing them to third parties for resale. Similarly, purchasing tickets with the intention of transferring them free of charge to third parties for profit purposes is prohibited.
3.If a customer violates paragraph 1 or 2, measures will be taken to prevent the customer from using or accessing all tickets purchased by the customer (regardless of whether the tickets are intended for resale). Refunds will not be issued in such cases.
4.If a customer violates paragraph 1 or 2 of the preceding clause, the customer's registration will be revoked, and the customer will be prohibited from purchasing tickets thereafter.
5.Customers are prohibited from engaging in the following activities when using the Service: (1) Acts that infringe or may infringe upon the copyrights, trademark rights, or other intellectual property rights, property rights, privacy, etc., of third parties, including the Museum or other customers. (2) Acts that violate public order and morals or may violate public order and morals, or providing information that violates public order and morals to third parties, including other customers. (3) Acts that constitute or may constitute a crime. (4) Election campaigns or similar activities, regardless of whether it is an election period. (5) Activities related to sex, religion, or politics. (6) Profit-making activities related to the Service without the Museum's consent. (7) Acts of falsifying or impersonating personal information, such as the customer's name, address, telephone number, or email address. (8) Acts of using or providing harmful programs, such as computer viruses, through or in relation to the Service. (9) Acts of using credit cards fraudulently. (10) Acts of using email addresses fraudulently. (11) Acts of listing tickets on auctions. (12) Acts of copying, tampering with, or counterfeiting tickets. (13) Acts that violate or may violate laws and regulations. (14) Other acts deemed inappropriate by the Museum.
Article 4 (Ticket Sales)
1.The types and prices of tickets that customers can purchase using the Service will be as stated on the sales page. However, the types and prices of tickets may be changed by the Museum without notice.
2.The timing of the conclusion of the sales contract between the Museum and the customer regarding tickets shall be at the time when the Museum approves the payment by the credit card company.
3.For tickets related to the planetarium, please specify the visit date and the start time of the projection when purchasing. After purchase, the visit date and start time of the projection can be changed only once. However, it is a condition that the change procedure is completed by 8:59 a.m. on the day of the visit. Tickets for exhibition rooms excluding the planetarium have a usage period of 6 months and cannot be changed. Please confirm before purchasing.
Article 5 (Payment Methods) The purchase price of tickets shall be paid via "credit card payment." Credit cards such as VISA, MasterCard, JCB, AMEX, and Diners Club are accepted. However, types of credit cards, such as virtual cards, that do not physically exist cannot be used.
Article 6 (Ticket Delivery) The method of receiving tickets is to access the purchase history of the Nagoya City Science Museum viewing ticket online sales site using the email address and application number registered at the time of purchase, and download the ticket (QR code). If multiple tickets are purchased, procedures for distributing tickets can be completed by the deadline set by the Museum. Customers must obtain the ticket (QR code) following the method of obtaining electronic data announced by the Museum and enter the designated entrance area. The ticket (QR code) can be printed for use. In the event that a customer forgets the mobile phone on which the ticket (QR code) was received on the day of use, or if the ticket (QR code) is damaged due to mobile phone malfunction or other reasons, no refunds will be issued. Even if a customer cannot receive the ticket (QR code) due to circumstances, the Museum will not refund the ticket price, service usage fees set by the Museum, payment-related fees, or delivery-related fees.
Article 7 (Refusal of Sale or Delivery)
1.The Museum may refuse to sell tickets or deliver tickets if customers meet the following criteria: (1) If customers make false statements regarding matters specified by the Museum or fail to make necessary statements. (2) If customers engage in acts that cause inconvenience to other customers or third parties or obstruct the smooth sale by the Museum. (3) If customers fail to complete the prescribed procedures within the deadline specified by the Museum. (4) If customers fail to adhere to the prescribed purchase methods. (5) If customers engage in acts that violate these Terms.
2.The Museum may seek damages from customers for any losses incurred by the Museum under the preceding paragraph.
Article 8 (Replacement, Modification, and Cooling-off of Tickets) Tickets that have been purchased and formed a contract cannot be replaced, modified (except for a one-time change of date and time for planetarium tickets), or canceled for any reason. However, this provision does not apply if the ticket purchase contract between the Museum and the customer is invalidated, canceled, or terminated by the customer due to the Museum's failure to fulfill obligations. Cooling-off does not apply to tickets sold through this Service.
Article 9 (Loss or Theft) The Museum will not reissue tickets under any circumstances (loss, theft, damage, etc.).
Article 10 (Refunds) The Museum bears no responsibility for changes, cancellations, or suspensions of exhibitions (including the planetarium). However, if a ticket is canceled or suspended, the Museum will refund the ticket price according to the method specified by the Museum. No refunds will be issued if the refund period has passed, the ticket (QR code) is damaged or lost, or if it is heavily soiled and difficult to identify. The refund amount will be limited to the ticket price, and the Museum will not be responsible for refunding or compensating for any costs other than the face value of the ticket (such as fees, transportation expenses, accommodation expenses, communication expenses, mailing fees, etc.). Customers agree in advance that it may take up to one month to process the refund.
Article 11 (End and Resumption of Sales) Sales for individual planetariums will end when the predetermined number of tickets is sold, even if it is within the ticket sales period at the Museum. However, sales may resume if additional usage slots are available.
Article 12 (Disclaimer Regarding Tickets)
1.The Museum is not responsible for tickets purchased directly from sources other than the Museum.
2.The Museum shall not be liable for any damages incurred by customers or third parties due to delays or impossibility in confirming the success or failure of ticket applications or purchases, or notifications thereof, caused by congestion in communication lines or unforeseen accidents on computer systems, etc.
Article 13 (Personal Information)
1.The Museum will record customers' personal information for the following purposes. Customers are deemed to consent to the recording of their personal information, such as ticket purchase history and usage history of this service (hereinafter referred to as "personal history"). If customers do not consent to provide personal information, they cannot use this service.
2.The Museum will use customers' personal information or personal history for the following purposes. In cases where personal information or personal history is used for purposes other than those specified in this article, the Museum will notify the customer of the intended use and obtain their consent. (1) Notification via email and other means regarding the sale of tickets and associated services related to customer applications. (2) Notification via email and other means regarding tickets handled by the Museum and Museum information. (3) User support related to tickets and the Museum (handling inquiries, etc.). (4) Provision of services related or incidental to this service. (5) Creation of statistical data for Museum marketing activities. (6) Responding to personal identification and inquiries based on legal requirements necessary for Museum operations.
3.Customers agree that the Museum may disclose personal information to third parties (hereinafter referred to as "service providers") to the extent necessary for outsourcing tasks and that service providers may use personal information within the scope necessary for performing the contracted tasks. In this case, the Museum will contractually obligate service providers not to disclose or leak personal information to other third parties and not to use personal information for purposes other than performing the entrusted tasks.
4.When customers purchase tickets with credit card payment, they agree that the Museum, which accepts ticket purchase applications, may exchange personal information with credit card companies to verify the validity of customers' credit cards.
5.The Museum may disclose all or part of customers' personal information and personal history to third parties without obtaining the customer's consent in the following cases: (1) Based on legal requirements. (2) When it is necessary to protect human life, body, or property, and obtaining the person's consent is difficult. (3) When it is particularly necessary to promote public health or the healthy upbringing of children, and obtaining the person's consent is difficult. (4) When cooperation is necessary with national or local government agencies or their commissioned parties to perform duties prescribed by law, and obtaining the person's consent may obstruct the performance of such duties.
6.The Museum will take reasonable measures to protect customers' personal information and personal history from leakage, loss, unauthorized access, alteration, destruction, etc.
7.The Museum will take reasonable measures to respond to the following requests from customers after confirming necessary information: (1) Disclosure of personal information to customers. (2) Correction, addition, or deletion of personal information. (3) Withdrawal of all or part of the consent already given regarding the use and disclosure of personal information.
Article 14 (System)
1.The Museum may change or suspend the systems related to this service without prior notice due to its necessity. The Museum shall not be liable for any damages incurred by customers due to such changes.
2.The Museum shall not be liable for any problems arising from the customer's actions, such as prolonged browser stoppage, termination, computer shutdown, network disconnection, etc., during the use of this service.
3.This service connects to sites and servers other than the Museum's.
4.This service uses JavaScript, SSL, and Cookies.
Article 15 (Exhibition Contents) Demonstrations and experiments at large exhibits on the day of admission may be changed or canceled without prior notice due to the Museum's circumstances. In this case, except for when the Museum is closed, ticket refunds will not be accepted.
Article 16 (Disclaimer)
1.Except as otherwise provided in this agreement, the Museum shall not be liable for any damages incurred by customers or third parties arising from the provision of various information in this service or other matters related to this service beyond the face value of the ticket. However, this does not apply if such damages are caused intentionally or by gross negligence of the Museum. The use of this service is entirely at the customer's own risk. The use of this service by minors shall be subject to the consent and responsibility of their legal guardians.
2.Although the Museum encrypts and carefully manages personal information input and transmitted by customers during the use of this service, it does not guarantee the prevention of information leakage, loss, tampering by third parties, etc.
3.The Museum does not guarantee the safety, accuracy, reliability, usefulness, currency, suitability for a particular purpose, legality, morality, etc., of the contents of this service, the information and services provided through this service, or the information obtained through this service or emails sent by the Museum. The Museum has no involvement with the information, services, etc., contained on sites linked from this service and assumes no responsibility for them.
4.The Museum does not guarantee that the quantity of tickets or other items sold through this service will fulfill all customer purchase requests and does not guarantee the truthfulness of the contents stated on tickets or other items sold through this service (including whether they will be conducted as stated). The Museum is not responsible for contacting customers at the contact information provided at the time of purchase.
5.The Museum shall not be liable for any damages incurred by third parties due to the actions of customers.
Article 17 (Governing Law) The effectiveness and interpretation of this agreement shall be governed by Japanese law.
Article 18 (Jurisdiction)
1.In the event of a dispute between a user and the Museum arising from or in connection with this service, both parties shall sincerely discuss and resolve the matter.
2.If a dispute cannot be resolved through the discussion referred to in the preceding paragraph, the Nagoya District Court or Nagoya Summary Court shall have exclusive jurisdiction as the agreed exclusive jurisdictional court.
Article 19 (Others) Customers shall follow the provisions separately determined by the Museum for matters not specified in this agreement.
